Texas Law on Domestic Violence

Domestic violence does not always involve two married people. Under Texas law, domestic violence includes assault by any person who lives with you or any member of your family. It also includes assault by someone you are currently dating or have previously been in a relationship with.

A person who commits domestic violence in Texas may be charged with one of three crimes:

  • Domestic assault occurs when someone threatens to physically harm you, makes physical contact of an offensive or provocative nature such as shoving, or inflicts physical harm through either intentional or reckless action.
  • Aggravated domestic assault occurs when the offender uses or displays a deadly weapon during an assault or when the offender intentionally or recklessly causes serious physical injury that requires immediate medical attention such as broken bones.
  • Continuous violence against the family occurs when the offender commits domestic assault two or more times within 12 months against you or any member of your family or household.
